The short version

My Dua Diary is for keeping, writing and improving your du’as, for your own personal use. Apple’s standard licence is the legal base for using the app. These terms add what is particular to My Dua Diary. Using the app means you accept both.

If anything here and Apple’s licence disagree about My Dua Diary, these terms win. Nothing in either takes away your legal rights as a consumer.

1. About these terms

1.1 These Terms of Use (the “Terms”) govern your use of the My Dua Diary mobile application (the “App”) and the related services we provide (together with the App, the “Services”). In these Terms, “My Dua Diary”, “we”, “us” and “our” refer to the provider of the Services, and “you” means the person using them.

1.2 Your licence to use the App is granted under Apple’s Licensed Application End User License Agreement (the “Apple Licence”), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms supplement the Apple Licence with provisions specific to My Dua Diary.

1.3 By downloading, accessing or using the Services, you agree to be bound by these Terms and the Apple Licence. If you do not agree, you must not use the Services.

1.4 If there is any conflict between these Terms and the Apple Licence in relation to My Dua Diary, these Terms prevail. Nothing in these Terms or the Apple Licence affects your statutory rights as a consumer.

1.5 Our Privacy Policy explains how we handle personal data, and forms part of these Terms.

2. Personal use

2.1 The Services are provided for your personal, non-commercial use only.

3. Religious content

3.1 Every du’a in the Quran & Sunnah section of the App is taken from a published source, which is cited alongside it. We take great care over the accuracy of the Arabic text, the translation and the reference.

3.2 The Services do not constitute a religious ruling, and nothing in them is a fatwa. For a ruling on your own circumstances, you should consult a qualified scholar whom you trust.

3.3 If you believe any content contains an error, please notify us at [email protected]. We will review it against the cited source and correct it where it is found to be wrong.

4. Guided Du’a

4.1 Guided Du’a uses artificial intelligence to help you compose a du’a, refine one you have written, or read one from a photograph. It is available only to users with a signed-in account.

4.2 Content generated by Guided Du’a may be inaccurate or incomplete, including in its Arabic, its meaning and any source it refers to. You should review all generated content, and verify anything of importance, before relying on it.

4.3 Guided Du’a does not provide advice of any kind, whether religious, medical, legal, financial or otherwise.

4.4 You are responsible for the content you submit to Guided Du’a. You must not submit the personal or private information of any other person.

5. Your content

5.1 The du’as you write, your notes, folders, chains and dhikr history are stored on your device only. We hold no copy of them.

5.2 Accordingly, we are unable to recover your content. If your device is lost, damaged or reset, or you delete the App, your content may be lost permanently. The App allows you to create a backup file, and you are responsible for keeping a current backup in a safe place.

6. Premium subscriptions

6.1 Premium is sold as a subscription through Apple, which processes all payments. Your subscription renews automatically at the end of each period until you cancel it. You may cancel at any time in your device’s Settings, under your name, then Subscriptions.

6.2 Refunds are at Apple’s discretion, and any request for a refund must be made to Apple. We do not receive or hold your payment.

6.3 Guided Du’a is subject to a usage allowance. The App shows how many uses remain and when the next Premium allowance becomes available.

6.4 Deleting your account does not cancel your subscription. You must cancel it separately in your device’s Settings.

6.5 The features included in Premium may change as the Services develop. If a change removes a feature you have paid for, you may cancel your subscription and request a refund from Apple.

7. Acceptable use

7.1 You must not:

  • access or use Guided Du’a by means of a script, bot or any other automated means;
  • copy the du’a library in bulk for the purpose of republishing it elsewhere, save that sharing an individual du’a through the features the App provides is permitted;
  • attempt to gain unauthorised access to the App or our systems, circumvent any usage limit, or use another person’s account.

7.2 If you breach this section, we may restrict your use of the Services or close your account.

8. Availability and changes to the Services

8.1 Guided Du’a requires an internet connection and, like any online service, may from time to time be slow or unavailable.

8.2 We may change, add or withdraw features of the Services. We will use reasonable efforts to give notice of any significant change.

8.3 An account that has never been signed in to is deleted automatically after 30 days without use, as described in our Privacy Policy. Content stored on your device is not affected.

9. Our responsibility to you

9.1 If you use the Services for any commercial or business purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

9.2 If we fail to comply with these Terms, or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result of our failure. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious that it will happen, or if, at the time you began using the Services, both we and you knew it might happen.

9.3 If defective digital content that we have supplied damages a device or digital content belonging to you, we will either repair the damage or pay you compensation. We will not be liable for damage that you could have avoided by applying an update offered to you free of charge, or that was caused by your failure to follow our instructions.

9.4 Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your statutory rights as a consumer, including your right to digital content that is as described, fit for purpose and of satisfactory quality.

10. Governing law and jurisdiction

10.1 These Terms are governed by the law of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of your home nation.

10.2 If you live in the European Union, you retain the benefit of any mandatory provisions of the consumer law of the country in which you live.

11. General

11.1 If any provision of these Terms is found by a court to be unlawful or unenforceable, the remaining provisions will continue in full force and effect.

11.2 If we do not enforce any of our rights under these Terms, or delay in doing so, that will not mean we have waived those rights.

11.3 Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you. Save for Apple, no other person has any right to enforce these Terms.

12. Changes to these Terms

12.1 We may amend these Terms from time to time. The date at the top shows when they were last changed. Where a change is significant, we will notify you in the App rather than leaving you to check.
